Variations in Cork
Cork products sold by Cork Imports Australia are made with high quality, natural materials and should be handled accordingly.
Like timber and stone, cork is a natural material and is subject to variations (such as colour, gloss, texture, etc.) between individual cork tiles and different batches. It is these naturally occurring variations that are a celebrated feature of cork, giving your project a natural and truly one-of-a-kind look.
While every effort has been made to achieve a unified look and feel in our products, we recommend taking care when making a selection based on a single sample. Samples are taken from our current stock and, together with photos, give an indication of the colour and texture of any supplied product, but will not be an exact replica.
Cork tiles should be verified before installation, we recommend distributing the tiles/planks in a way that variations are not striking.

Purchase of Products through Website

Following payment of the Purchase Price being confirmed by Cork Imports Australia, you will be issued with a receipt to confirm that the payment has been received and Cork Imports Australia will keep a record of your purchase details.

Shipping and Delivery

You acknowledge that the Purchase Services offered by Cork Imports Australia integrate delivery (Delivery Services) through the use of third-party delivery companies (Delivery Service Providers). Your personal details will be provided to Delivery Service Providers to facilitate delivery.

It is the buyer's responsibility to ensure the accuracy of their contact details. If a buyer suspects an error, they must contact Cork Imports Australia promptly. If feasible, we will make necessary corrections before posting the Product.

Free domestic shipping across Australia is available for Products purchased through the Website. Products are usually dispatched within 2 business days from our warehouse in Murarrie, QLD.

Products are usually sent with standard shipping by Australia Post, please refer to Australia Post’s website for the most up to date information on shipping times.

Other shipping options may be available for an additional charge, please contact us for a quote before making a purchase.

In the event that an item is lost or damaged in the course of the Delivery Services, Cork Imports Australia asks that you contact us with details of the issue so we can investigate. In some circumstances you may be required to contact the Delivery Service Provider directly to request a refund or to claim on any insurance options, if applicable.

Refunds

At Cork Imports Australia we are committed to the quality of our Products and value customer satisfaction. Where you believe a Product is faulty or defective, please refer to our Warranty section for assistance.

Refunds for change of mind are not provided; however, we encourage you to contact us to discuss your specific situation. Your satisfaction with our Products is important to us.
In some circumstances, Cork Imports Australia may, at their sole discretion, provide a refund or credit on the return of the Products where there has been a change of mind, provided the product was dispatched within the last 6-months, is unopened and/or unused, has been stored properly, and remains in a saleable condition. A restock fee of 30% will apply and you acknowledge and agree that you are liable for any postage and shipping costs associated with any refund pursuant to this clause. -
Any refunds will be made on the original payment method.

You expressly understand and agree that Cork Imports Australia, its affiliates, employees, agents, contributors, third party content providers and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. Where you believe you may have a claim under these Terms or the Australian Consumer Law, you must notify Cork Imports Australia in writing within 7 days of the issue arising, providing all relevant details and supporting documentation. Any claim not notified within this timeframe may be rejected unless you can demonstrate that the delay was reasonable in the circumstances. This notification requirement does not limit your rights under any non-excludable consumer guarantee under the Australian Consumer Law.

Termination of Contract

The Terms will continue to apply until terminated by either you or by Cork Imports Australia as set out below.

If you want to terminate the Terms, you may do so by:

notifying Cork Imports Australia at any time; and

closing your accounts for all of the Purchase Services which you use, where Cork Imports Australia has made this option available to you.

Your notice should be sent, in writing, to Cork Imports Australia via the 'Contact Us' link on our homepage or through email at sales@corkimports.com.au
Cork Imports Australia may at any time, terminate the Terms with you if:-
you have breached any provision of the Terms or intend to breach any provision;

Cork Imports Australia is required to do so by law;

the partner with whom Cork Imports Australia offered the Purchase Services to you has terminated its relationship with Cork Imports Australia or ceased to offer the Purchase Services to you;

Cork Imports Australia is transitioning to no longer providing the Purchase Services to Members in the country in which you are resident or from which you use the service; or
-
the provision of the Purchase Services to you by Cork Imports Australia is, in the opinion of Cork Imports Australia, no longer commercially viable.

Subject to local applicable laws, Cork Imports Australia reserves the right to discontinue or cancel your membership to the Website at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Purchase Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Cork Imports Australia‘s name or reputation or violates the rights of those of another party.

Dispute Resolution

Compulsory
If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought). -
Notice
A party to the Terms claiming a dispute (Dispute) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute. -
Resolution
On receipt of that notice (Notice) by that other party, the parties to the Terms (Parties) must:-
within 30 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree.

If for any reason whatsoever, 30 days after the date of the Notice, the Dispute has not been resolved, the Parties must either:

agree upon selection of a mediator, or
-
if both Parties agree, commence with Tribunal or Court proceedings.

Where Parties choose Mediation

The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation.

The mediation will be held in Brisbane, Queensland, Australia.
-
If 2 months have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

Where Parties choose Tribunal or Court Proceedings

The Parties agree to the terms and conditions in sections 15.Venue and Jurisdiction and 16. Governing Law.

Confidential
All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

Venue and Jurisdiction

The Purchase Services offered by Cork Imports Australia are intended to be used by residents of Australia.

In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Brisbane, Queensland, Australia.

You agree to submit to the jurisdiction of courts situated in Brisbane, Queensland, Australia and agree that venue in these courts is proper in any such legal action or proceeding. You also agree that you not assert, in any legal action or proceeding involving Cork Imports Australia, that a court sitting in Brisbane, Queensland, Australia is an inconvenient forum for such legal action or proceeding.

The Terms are governed by the laws of Queensland, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Queensland Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.

Severance
If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
